Standard Rental Agreement

The agreement is entered into between the following parties:

The owner confirms that the boat is seaworthy, legally registered, properly maintained and insured, and that required safety equipment is on board and in regulatory condition.

The boat must be picked up and returned at the agreed time and place. Late return may result in an additional charge per commenced hour, as well as liability for any loss the owner suffers as a result of the delay.

At launch, payment goes through Sailfloat with Vipps or card, the deposit is pre-authorised on the Renter`s card and released automatically after return if no damage or breach is reported, and settlement to the Owner happens after the rental is completed. No payment can be made through Sailfloat today.

The renter undertakes to:

• operate the boat sober and never under the influence of alcohol or other intoxicants;
• observe applicable speed limits, local regulations and rules of the road at sea;
• continuously assess weather conditions and refrain from sailing in unsafe conditions;
• not exceed the maximum number of persons or the boat's load capacity;
• ensure that everyone on board wears approved flotation devices, and that children are properly secured;
• only use the boat within the agreed operating area and not sublet or hand over control to unauthorized persons;
• treat the boat and equipment with care and report any damage or faults without undue delay.

Whoever operates the boat must satisfy the licence requirements in force where the boat is used. In Norway these follow from regulation of 3 March 2009 no. 259: a boating licence is required for persons born on or after 1 January 1980 for boats over 8 metres (26.25 ft) or engines with output greater than 25 hp. The minimum age is 16 if the boat has an engine with output greater than 10 hp — this applies regardless of whether a licence is required. If the boat is used in another country, that country's rules apply instead.

At pickup, the parties jointly inspect the boat's condition and equipment, and note any existing marks or damage. The owner provides a walkthrough of operation, safety equipment and local conditions.

The boat must be returned in the same condition as at pickup, cleaned and with the same fuel level, at the agreed time and place. At return, the boat is inspected again and any new damage is documented with photographs.

Unless otherwise agreed, the boat is delivered with a full tank and must be returned with a full tank. Missing fuel will be invoiced based on actual consumption with a reasonable surcharge for the owner's refueling. The agreed fuel level at pickup is noted in section 6.

The Renter is liable for damage to the boat and equipment arising during the rental period, capped at the deductible stated in section 4, provided the damage is covered by an insurance that applies to the rental.

The deductible does not lapse, and the renter may be held liable beyond the deductible, if the damage is caused by gross negligence, intoxication, breach of this agreement, or use outside the agreed operating area. Damage to personal belongings is not covered. Damage must be reported without undue delay and no later than at the time of return.

Sailfloat provides no insurance and is not a party to this agreement, see clause 3.1 of the terms of use. The Owner's own policy is what applies. Renting out for payment is often excluded from ordinary leisure-boat insurance, and the Owner is responsible for having cleared rental with their insurer before the boat is rented out. The parties should agree in writing who carries the deductible in the event of damage.

Cancellation is governed by the cancellation policy selected for this boat and confirmed at booking. The three policies are:

If the trip cannot safely be completed due to weather or other circumstances beyond the parties' control, either party may cancel without cost.

The agreement is governed by Norwegian law. Disputes shall be sought resolved amicably, and may otherwise be brought before the ordinary courts. For the relationship with Sailfloat, the terms of use apply, including provisions on venue and consumer bodies.

The parties confirm that they have read and accepted this rental agreement. Confirmation of the booking in Sailfloat is considered electronic signing and is equally binding as a handwritten signature.

A confirmed, signed copy of the agreement is made available to both parties under "My Bookings".
